These Terms & Conditions ("Terms") govern your use of Kinabit (the "Service"), provided by Daniel Fitoussi ("we", "us", "our", the "Seller"). By creating an account or using the Service, you agree to be bound by these Terms.
1. The Service
Kinabit is a software platform for physical therapists to manage patients, design exercise treatment plans, track patient adherence, and review clinical check-ins. The Service is a clinical workflow tool — it does not replace professional medical judgement.
2. Accounts and Authority
You must provide accurate registration information and keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. If you register on behalf of an organization, you confirm you have the authority to bind that organization. If you register as an individual, you confirm you are of legal age in your jurisdiction.
3. Acceptable Use
You agree not to misuse the Service. In particular, you may not: (a) use it for unlawful purposes; (b) commit fraud or send spam through it; (c) infringe intellectual property rights; (d) interfere with the security of the Service, including by introducing malware, probing, scanning, or scraping; (e) reverse engineer, resell, or redistribute the Service; or (f) circumvent any technical limitations.
4. Intellectual Property
The Service, including all software, designs, branding, and documentation, is owned by the Seller and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service for the duration and within the scope of your subscription.
5. User Content
You retain ownership of patient records, notes, and other content you upload. You grant us a limited license to host and process that content solely to provide the Service to you. You are responsible for ensuring you have the legal right to upload patient information and for complying with applicable healthcare and privacy laws in your jurisdiction.
6. Beta Access and Pricing
Kinabit is currently offered through an invitation-only Design Partners beta program. Selected clinics receive temporary beta access in exchange for product feedback. There are no fees during the beta period and no payment method is required.
At the end of the beta period, continued access may require a paid subscription on terms communicated to you in advance. You are under no obligation to continue.
7. Service Level
We work hard to keep the Service running smoothly, but we do not guarantee uninterrupted or error-free performance. Maintenance, third-party outages, and unforeseen issues can cause downtime.
8. Warranties and Liability
To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. Our aggregate liability for any claim arising from these Terms is capped at the fees you paid for the Service in the twelve (12) months preceding the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury where such exclusion is prohibited by law.
9. Indemnity
You agree to indemnify us against claims arising from your content, your unlawful use of the Service, or your violation of these Terms.
10. Suspension and Termination
We may suspend or terminate your access for: (a) material breach of these Terms; (b) non-payment; (c) security or fraud risk; or (d) repeated or serious policy violations. Upon termination, you may export your data within 30 days, after which it may be permanently deleted.
11. Governing Law
These Terms are governed by the laws of the Seller's jurisdiction. Disputes will be resolved in the competent courts there.
12. Changes
We may update these Terms from time to time. Material changes will be communicated via email or in-app notice.
